Cancellation of Portuguese Timeshare

We were engaged by a UK-based couple seeking our assistance to cancel a Timeshare product in Portugal.

The clients had purchased a Timeshare at Clube Albufeira in the early 1990’s. Over the years they found that they were using the Timeshare less and less and, eventually, stopped using the Timeshare all together. However, they were still obliged to pay the annual maintenance fees regardless of whether they used the Timeshare or not.

Unsurprisingly they no longer wished to pay the annual maintenance fees for something they no longer used.

Initial free consultation and viability Report

After discussing the history of the case with the clients and studying all the relevant documentation, and applying the relevant case law, we provided to the clients our free Timeshare feasibility Report. This Report typically highlights the legal position, and any available remedies open to clients. The Report for these clients duly confirmed that we could cancel the Timeshare for them despite their use of the Timeshare for several decades prior.

Timeshare Cancellation Solution implemented

We received a formal instruction to proceed and subsequently put our Timeshare cancellation solution into place. Following correspondences with the Resort in Portugal, we successfully cancelled their ownership, meaning they were relieved of the annual burden of the Timeshare maintenance fees. In this particular case we also received written confirmation from the Resort that the cancellation was successful, and our clients had no further financial obligations to the Resort.

Outcome

This matter was quickly finalised, enabling our clients to finally draw a line under their Timeshare ownership and be released from any threats to their future.
