What happens if you stop paying a Spanish mortgage?

If you fall into arrears on a Spanish mortgage, your lender will typically make contact, issue formal notices, and, if payments are not restored, begin formal legal proceedings. This process can ultimately lead to the property being sold at public auction (subasta).

Spanish mortgage enforcement doesn’t necessarily end with the loss of the property. If the auction proceeds fall short of the outstanding debt, the bank may pursue you for the remaining balance. Acting early gives you the most options.

Can a Spanish bank pursue me in the UK or Ireland?

Yes. Spanish banks can, and do, pursue borrowers living in the UK or Ireland for outstanding mortgage shortfalls. A judgment obtained in Spain can be registered and enforced against UK assets, including property. If you’ve received a demand or legal notice, or are informed a Charging Order has been placed upon your UK property, you must take it seriously and seek advice promptly.

What is a vulture fund, and why has one contacted me?

A vulture fund is an investment company that buys distressed mortgage debts from banks, typically at a significant discount, and then pursues borrowers for the full amount owed. Spanish banks have sold large portfolios of non-performing loans to funds such as Cerberus, Blackstone, and Axactor.

If you’ve received a letter or call from one of these organisations, it means your debt has been sold on. You have legal rights in this situation, and it’s not too late to seek help. Your options if you cannot pay your Spanish mortgage

Renegotiating the mortgage term or rate

If you’re in the early stages of difficulty, it may be possible to restructure the mortgage by extending the loan term, agreeing on an interest-only period, or negotiating a partial write-off. Banks generally prefer renegotiation to the cost of repossession, but they’re more likely to engage if you approach them through a solicitor.

Dación en pago (handing back the keys)

Dación en pago is a formal agreement by which you return the property to the bank in full settlement of the mortgage debt. Unlike simply walking away, a properly agreed dación en pago releases you from any further liability, including any shortfall. There’s no automatic right to demand one, but banks can sometimes be persuaded, particularly where enforcement would leave a significant shortfall. There are certain circumstances where the bank does have to accept it however, but we find most of our clients would not fit the applicable criteria.

Negotiated debt settlement

Where repossession has already taken place, or where the bank or vulture fund is pursuing a shortfall, it may be possible to negotiate a lump-sum settlement for less than the full amount owed. Funds that purchased debts at a discount often have more flexibility than the original lender.

Selling the property (short sale)

If you still own the property but can’t keep up with repayments, selling it before proceedings reach an advanced stage may help you avoid the worst outcomes. A negotiated short sale can sometimes form part of a broader settlement with the lender. We can help coordinate this alongside our selling property in Spain service.

Defending court action in Spain and in the UK

If your lender has already issued court proceedings, or if a Spanish judgment is being enforced against you in the UK, you may have the right to mount a legal defence. Grounds for challenge can include procedural irregularities, abusive contract terms, or errors in the amount claimed. Challenging abusive mortgage clauses (floor clauses)

Many Spanish mortgages issued before 2013 contained a cláusula suelo (floor clause), which set a minimum interest rate regardless of how far the Euribor benchmark rate fell. Spanish courts, and later the Court of Justice of the European Union, ruled that these clauses were often unfair and had been imposed without adequate explanation. Borrowers may be entitled to reclaim the overpaid interest.

Mis-sold Spanish mortgages

Some English-speaking buyers were sold Spanish mortgages without being properly advised of the terms, the currency risks, or the financial obligations they were taking on.

If your mortgage was arranged by an agent or adviser who failed to explain the full picture, or if the documentation wasn’t provided in a language you could understand, there may be grounds for a mis-selling claim. This type of claim can sometimes be brought alongside other proceedings, such as a defence to repossession.
