Evicted on False Grounds? What Dubai Tenants Need to Know
In Dubai, tenants are increasingly reporting evictions under the pretext of “family use”. While the law does allow landlords to reclaim property for personal or family occupation, it sets out strict conditions that must be followed. Unfortunately, some landlords misuse this provision, only to re-rent the property at a higher price once the tenant has vacated.
Why Are Landlords doing this?
With rents rising in Dubai, landlords are motivated to remove long-standing tenants who benefit from capped rental increases. Claiming the property is needed “for family use” is one of the few legal avenues available—but it comes with conditions that many landlords ignore.
What the Law actually says
Under Article 25(2) of Dubai Law No. 33 of 2008 (amending Law No. 26 of 2007), landlords can only reclaim a property for family use if the following requirements are strictly observed:
- A 12-month notice must be served through a notary public or by registered mail.
- The property must be genuinely used by the landlord or their immediate family.
- Once vacated, the landlord is prohibited from re-letting the property for two years in residential cases and three years in non-residential cases.
If these conditions are not respected, the eviction may be deemed unlawful.
